Terms of Service
_{Please Read Carefully}

By commissioning me in any kind of way, you are agreeing to the terms of service below.

General
_{All commissions are experimental to some degree. If you are not okay with this please refrain from commissioning.}
_{I reserve the right to refuse any commission, trade or request for any reason, disclosed or not.}
_{I reserve the right to cancel and refund a commission at any point.}
_{Any innapropriate/rude behaviour will not be tolerated and may cause your commission to be canceled if it occurs. Further behaviour will get you blacklisted}
_{If you need your commission done by a certain date, let me know before I accept your commission. I won't accept a deadline less than 2 weeks.}
_{Both parties agree to keep any sensitive or personally identifying information private. This includes payment information, more discreet contact info, dead/legal names, etc.}

Payment
_{Do not send payment until I accept your commission and we have agreed on the final price for the piece.}
_{I prefer commissions be paid for in full upfront, but I will allow payment plans. As long as the full total has been paid, I will start on your piece.}
_{Accepted currency is USD.}
_{Payment VIA Paypal or Ko-fi Only. I will not cover any extra costs that result from incorrect payments.}

Process & Revissions
_{Contact me on Discord, Instagram or Toyhouse if you are interested in commissioning me. Once I get back to you, please include all of the details & reference photos of the commission.}
_{If an actual character reference is not provided and only text or a moodboard is, I will consider this a custom. This means I would be the design owner/creator and the original price will rise. I will not always accept these kinds of commissions.}
_{Updates will be when the sketch/lineart is ready for approval.}
_{Feel free to ask for additional updates, I will be happy to show you additional WIPs as I progress through the artwork- But do not rush me. I have a schedule and will do your commission during that time. Check my trello for updates.}
_{You are free to ask me to edit things when you are given the sketch work-in-progress update with no additional fees.}
_{You may request changes at any time and point in the process, as long as it doesn't require a big redraw of the image. If you request many small changes over the course of your commission, I may ask for an additional small payment.}
_{Any major changes midway during the process, such as; an outfit change, different pose, complex background change or anything that makes me have to redraw it completely. Will come with an extra charge.}
_{To check my weekly schedule, which is likely to change per week because I am casual, please refer back to my trello. On my days off I may answer messages from clients, but I will not be providing updates. You’re welcome to message on these days, but please don’t expect any responces until it is one of my scheduled days.}

Cancelation & Refund Policy
_{If I can't finish the commissioned piece due to things happening on my end, I'll refund the client in full. This does not include any Paypal fees}
_{If payment has not yet been sent, the commissioner has the right to cancel the commission.}
_{If you cancel before the sketch is done, you will receive a full refund. And I recieve full rights to repurpose whatever progress has been made}
_{If you cancel and request a refund after the sketch has been received & approved, then you will recieve a partial refund (% depends on completion level). You're free to keep the sketch and use it according to my useage permissions below.}
_{Refund requests for finished/nearly finished pieces are not accepted.}
_{Please contact me before doing a chargeback. I am open to discussing refunds, so there shouldn't be a reason for one.}
_{If you file a chargeback without contacting me prior or if you do so when i have already finished your art, your right to anything I have ever made for you will be retracted and i may repurpose it however i see fit . Since it wasn't paid for it isn't yours. You will be blacklisted, blocked and your name will be publicly posted as a warning to others. I also have every right to file a dispute/complaint and to the money you have given me.}

Designs & Adopts
_{Crediting for original design is mandatory.}
_{This will be your character from now on. As long as they are not used in problematic material, you may use them as you wish.}
_{If the design has a TH profile, do not private or delete it. I like to check up on them sometimes, and this also serves for archival purposes.}
_{It's appreciated if I am notified before transfers, but not required.}
_{Resales/trades/gifts should be on a personal basis, with added value thru comms paid w real money, etc.}

Copyright & Usage Policy
_{Artworks/Designs made by RedMageofVoid are never to be sold or minted as non-fungible tokens (NFTs) or used in any blockchain-related technology, cryptocurrency, or future inventions in the space.}
_{Artworks/Designs made by RedMageofVoid are never to be reproduced/fed into AI programs/bots or any future inventions in the space.}
_{Reproducing/using the copyrighted artwork commercially (meaning making money of it in any way) is considered infringement.}
_{Taking Credit for the creation of the artwork is considered infringement.}
_{Removing any watermarks/signatures is considered infringement.}

As the Artist, I;
_{hold every right to the produced artwork.}
_{Am allowed to use the copyrighted artwork to Promote myself, display & post it anywhere.}
_{May recycle discarded sketches and other unused preparatory work for future projects or future ideas for other artworks.}

As the Client, you may;
_{Use the copyrighted artwork for personal use. This includes; in edits, use on websites/social media, posting the full size version & any wips with credit, and making prints or other goods for yourself or as unpaid gifts.}
_{Claim the right of your character(s) but not the artwork itself.}
_{Use the art to promote yourself with proper credit given to the artist.}
_{Purchase Commercial rights to the artwork at any time for 200% of the original price. With commercial rights you are allowed to; make any sort of merchandise with the artwork, use it in books, covers, as props, change it to your liking and promote your own brand with it.}
_{Credit is still required for usage of the artwork, even if altered or edited.}
